On 9-17-11 at 2356, I was working uniform patrol (3E13). I was dispatchedto an assault at 10 E Pike ST. As I was driving into the area, radioupdated with a suspect described as a Hispanic or Indian male, over sixfeet tall, wearing a yellow golf hat and a black jacket and last seenwalking W/B on 10 ST from Broadway AV. I arrived in the area and saw V/ walking on the south sidewalk andpointing towards the upper parking lot entrance to 14 Broadway AV. Iturned north into the parking lot and saw a male, matching the suspectdescription and later identified as S/ attempt to hide in some bushes on the west side of the entrance. I directed S/ to come outof the bushes and took him into custody. S/ was read his Miranda Warnings from an SPD MIR card. When askedif he understood, S/ said he did. S/ told me the following. Earlier that night while talking to whathe thought was a woman, S/ said he, “felt an erection.” Learningthat the woman he was flirting with was a man, S became very upset. He repeatedly told me that he was not “a faggot.” He told me that homosexuals put “dicks in butts,” and told me that he didn’t do that.S became so upset, spitting and yelling homosexual slurs, that Iwas unable to learn what happened at the listed location.
when S/ approached them and began calling them “faggots.” S/ continued yelling homosexual slurs until W/ told him that he neededto understand that he was on Capitol Hill. On hearing this, S/ struck V/ in the face with a closed fist causing his nose to bleed.V/ pushed S/ back and S/ reached into his pocket andtold V/ that he had a knife. (No actually knife was seen and noknife was found.) S/ then left the area W/B. V/ followed andcalled 911. At one point during the pursuit, S/ turned and througha metal, folding “No Parking” sign and struck V in the face.Police took S/ into custody soon after. Video statements from the victim and witness were taken by Ofc Laina – 7606. Ofc Laina took photographs of V/ ’s injuries. I placed thosephotographs into evidence.
I transported S/ to the E PCT for processing and booking into KCJ. The arrest was screened by SGT Hotnit and LT Towne.
